Terms and Conditions


Effective Date: January 1, 2026

Welcome to Film Youth Sports! These Terms and Conditions outline the policies and agreements between Film Youth Sports ("we," "us," "our") and our clients ("you," "your") for photography services. By booking a session with us, you agree to these terms.

1. Services Offered

Film Youth Sports specializes in:

  • High school sports photography

  • Youth sports photography

  • Senior portrait photography

  • Family photography

  • Business/professional individual photography

All images are professionally hand-edited and typically delivered digitally within 48 hours or less of your session.

Please denote that we do not typically do infant and will not do wedding photography.

2. Booking & Payment Terms

Session Packages

We offer the following photography packages:

  • 2-Hour Session: $655

  • 1.5-Hour Session: $510

  • 1-Hour Session: $340

  • 30-Minute Session: $180

Special Offers

  • Returning Athlete Discount: Athletes previously photographed for sports receive 20% off senior portrait sessions.

Payment

  • A non-refundable booking fee equal to the full session price is required to reserve your date and time.

  • Payment is due at the time of booking via our secure payment system.

  • By submitting payment, you confirm your agreement to these Terms and Conditions.

3. Session Policies

Punctuality

  • Please arrive on time for your scheduled session.

  • If you arrive more than 15 minutes late, we may need to shorten your session to accommodate other scheduled clients, with no refund for reduced time.

Overtime Charges

  • If your session runs over the scheduled time due to late arrival, additional setup requests, or other delays, overtime is billed at $180 per each additional 30 minutes.

  • Overtime charges will be invoiced separately and are due within 7 days.

Cancellations & Rescheduling

  • Cancellations: Booking fees are non-refundable. If you cancel for any reason, the booking fee will not be returned.

  • Rescheduling: You may reschedule your session once at no charge if notice is provided at least 48 hours in advance. Subsequent reschedules may incur a full session rescheduling fee.

  • Same-day cancellations or no-shows result in forfeiture of the booking fee with no option to reschedule.

4. Weather & Unforeseen Circumstances

Outdoor Sessions

  • In the event of inclement weather (rain, extreme heat, unsafe conditions), we will work with you to reschedule at no additional cost.

  • The photographer reserves the right to cancel or reschedule a session due to unsafe weather conditions.

Photographer Illness or Emergency

  • If we must cancel due to illness, emergency, or unforeseen circumstances, we will reschedule your session at no additional cost or provide a full refund of your booking fee.

5. Copyright & Ownership

Photographer Retains Copyright

  • Film Youth Sports retains full copyright and ownership of all images created during your session.

  • This means we own the original files and have the exclusive right to reproduce, display, and distribute the images.

What This Means for You

  • You receive a personal usage license (see Section 6) to use your images, but you do not own the copyright.

  • Images may not be altered, edited, or modified in any way without our written permission.

6. Client Usage License

Upon delivery of your final images, you receive a non-exclusive, perpetual license to use your photos for personal purposes, including:

✅ Allowed Uses:

  • Printing for personal use (home display, gifts, etc.)

  • Sharing on personal social media accounts (Instagram, Facebook, etc.)

  • Creating graduation announcements, thank-you cards, or similar personal materials

  • Displaying in your home or giving to family and friends

❌ Prohibited Uses:

  • Commercial use (selling, advertising products/services, etc.)

  • Reselling or redistributing the images

  • Entering images into contests or competitions without our permission

  • Any alterations, heavy filters, or editing that changes the original artistic intent

Credit Appreciated: While not required, we kindly ask that you tag or credit @FilmYouthSports when sharing images on social media.

7. Model Release & Promotional Use

By booking a session with Film Youth Sports, you grant us permission to use images from your session for:

  • Portfolio display on our website and social media

  • Marketing materials (print, digital, online advertising)

  • Blog posts and promotional content

  • Before/after editing examples

If you do NOT want your images used for promotional purposes, please notify us in writing at the time of booking. We will honor your request with no questions asked.

8. Image Delivery & Turnaround

  • All edited images will be delivered digitally via an online gallery typically within 48 hours or less of your session.

  • You will receive a link to download high-resolution digital files.

  • The online gallery will remain active for 90 days. Please download your images within this timeframe.

  • After 90 days, we are not responsible for maintaining access to your gallery, though archived images may be available upon request for a small retrieval fee.

9. Retouching & Editing

  • All images are professionally hand-edited for color correction, exposure, and artistic style.

  • Basic retouching (blemish removal, minor adjustments) is included.

  • If you request additional retouching beyond our standard editing (extensive skin editing, background changes, etc.), additional fees may apply.

10. Privacy & Data Protection

We take your privacy seriously.

What We Collect

  • Name, email, phone number, and payment information necessary to provide our services.

What We DON'T Do

  • We will NEVER sell, rent, or share your personal information with third parties for marketing purposes.

How We Use Your Information

  • To communicate about your session (scheduling, delivery, etc.)

  • To process payments securely

  • To send occasional updates about our services (you may opt out at any time)

Data Security

  • We use industry-standard security measures to protect your information.

  • Payment processing is handled through secure, encrypted third-party payment processors.

11. Liability Limitations

Property Damage

  • Film Youth Sports is not responsible for damage to personal property, locations, or equipment during sessions unless caused by our gross negligence.

Personal Injury

  • While we take every precaution to ensure safety during sessions, you participate at your own risk.

  • Film Youth Sports is not liable for injuries sustained during photography sessions unless caused by our gross negligence.

Image Quality & Technical Issues

  • We use professional equipment and take great care with every session.

  • In the rare event of equipment failure, memory card corruption, or other technical issues that result in lost images, our liability is limited to a refund of your booking fee or a complimentary reshoot (if possible).

Maximum Liability

  • In any case, our total liability to you shall not exceed the amount you paid for your session.

12. Refund & Cancellation Policy

  • Booking fees are non-refundable once paid, except in the following cases:

    • We cancel due to illness, emergency, or unforeseen circumstances and cannot reschedule.

    • Equipment failure or technical issues prevent us from delivering any usable images.

  • If you are unsatisfied with your images due to our error (incorrect editing, missed shots agreed upon in advance), we will offer a complimentary reshoot if feasible. We reserve the right to determine what is and what is not acceptable.

13. Client Responsibilities

To ensure the best possible experience and results, clients agree to:

  • Arrive on time and prepared for the session

  • Communicate any specific requests, concerns, or needs in advance

  • Provide accurate contact information for session coordination

  • Respect our creative process and artistic decisions

  • Treat our equipment and the photographer with respect

14. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.

15. Governing Law

These Terms and Conditions are governed by the laws of the State of Michigan. Any disputes will be resolved in the courts of Ingham County, Michigan.

Acceptance of Terms

By booking a photography session with Film Youth Sports, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. In addition, we fully reserve the right to not accept bookings if we determine that it is not going to be a positive experience for all.
